MSBA Mid-Year Meeting
The ADR Section put on a program at the MSBA’s
Mid-Year meetings in Las Vegas in February. The theme for the programs was
"Top Ten" lists, a la David Letterman. The ADR Section presented the
Top Ten Things to Consider about Alternative Dispute Resolution (ADR). Although
the theme was Top Ten, between the two halves of the presentation, attendees
heard a total of 21 tips regarding ADR. "21".... How appropriate for a
meeting in Las Vegas!
Judge Paul Dorf of Adelberg, Rudow, Dorf &
Hendler, LLC, presented the first portion of the program. He discussed various
forms of ADR with which he has been involved as a neutral. He touched on his
experiences as a mediator, arbitrator, and he also discussed his involvement in
Med-Arb and Arb-Med hybrids.
Jonathan Rosenthal concluded the session by
discussing additional points on mediation. Included in that presentation were
distinctions between mediation and settlement conferences according to the
Maryland Rules, points to consider while representing clients in mediation, and
ideas on how to use your litigation skills during mediation.
Judge Dorf and Mr. Rosenthal then fielded
questions from the attendees ranging from the Judge’s style for conducting
Meditations to a discussion, albeit brief, on a lawyer’s responsibilities in
advising a client as to his, her, or its ADR options
