Learn the basics of construction law, its unique terminology, and who the players are in the contracts and disputes.  The program will include discussion of the most important construction contract provisions and the issues that can arise from them.  The contractual, tort, statutory and regulatory relief that are part of trying and/or defending a construction case will also be discussed.  A short summary or recent case law and legislation affecting the construction industry will also be included.

What a Construction Attorney Needs to Know About MOSH and OSHA Inspections:  Is This Really Just a MOSH Pit?


MISSION STATEMENT:

The purpose of the Construction Law Section of MSBA is to bring together Maryland lawyers who practice construction litigation or construction law related to real estate transactions practices with a variety of educational and social activities.  The Section events should enhance the camaraderie and professionalism among construction law practitioners.  Moreover, the Section’s sponsorship of educational programs, updates on developments in law and legislation, and written materials and resources for practitioners should promote a higher caliber of legal practice among Section members and across the Bar generally. 


2011/2012 ANNUAL REPORT:

This Section created a Maryland Construction Law Deskbook, written and edited exclusively by Section Members, as a signature event in its inaugural year as a recognized Section. It also held a number of events, including: a “hot topics” happy hour in September; a well-received Government Contracts Litigation discussion panel and dinner, co-sponsored by the MSBA Litigation Section, in November; a discussion and meeting regarding Maryland Occupational Safety & Health (MOSH) Actions in the Construction Industry in January; a lunch seminar on the Nuts & Bolts of Mechanic’s Liens in March, and a CLE program surrounding the new Construction Law Deskbook. The Section also: held a joint meeting with the Virginia State Bar’s Construction Law and Public Contracts Section in Bethesda in April; provided basic construction law training for the Judicial Conference; held meetings by videoconference in several locations to accommodate members from all areas of the state; and produced a tracking report of hundreds of relevant bills pending in the Maryland, as well as annual and quarterly case-law updates. It will present a Basics of Construction Law program and a joint presentation with the Environmental Law Section at the MSBA Annual Meeting.
