While the casualty and condemnation terms of leases and ground leases seldom receive the attention (or even the patience) of our clients, a thoroughly considered and well-drafted casualty provision is what they will expect to see if unfortunate circumstances demand landlord and tenant turn to the back of their lease.  This panel will explore the positions of landlords and tenants in casualty provisions, analyze those positions for the different lease types, and integrate a comprehensive discussion of insurance coverage concepts. Hear from practitioners and an insurance professional about how to be effective in drafting and negotiating technically appropriate and functional lease provisions.  Concepts covered will include: force majeure; termination rights, rent abatement, restoration obligations, and insurance requirements.
