Data Breach Liability and Cyber Security Litigation

Description

Two of the largest lawsuits in the country right now are based on data breaches – Equifax and Marriott/Starwood.  This presentation is a  review of recent data breaches and the potential liability associated with them based on lawsuits dealing with cyber security litigation, relevant statutes and case law.  Cyber security provider should be aware of the growing risk of exposure to lawsuits for negligence when data breaches or other security failures occur.  Ultimately, these lawsuits will help bring pressure on the industry to improve security standards by adjusting the risk/reward ration due to long term economic consequences.
