Topic: The Surviving Spouse’s New Paradigm: The Elective Share Enters the 21st Century
On October 1, 2020, Maryland’s new elective share law will go into effect providing a surviving spouse with the right to receive a share of the deceased spouse’s probate and non-probate assets. This program will address what is meant by the augmented estate, how the elective share amount is calculated, what adjustments are made, how the elective share amount gets paid. The program will explain how the new law effects estate planning and how spousal consents and marital agreements will become important tools in the planning process.
