The distinction can determine tax obligations, wage rights like minimum wage overtime, and employment obligations like sick leave and workers’ compensation—and when a business gets it wrong, it can have huge implications for liability. Learn what defines an employee versus an independent contractor under key statutes; how employment status is addressed differently under the National Labor Relations Act, the Fair Labor Standards Act, the Internal Revenue Code, and Maryland wage laws; the impact of the U.S. Department of Labor’s new independent contractor rule; and what remedies are available when an employee is misclassified as an independent contractor.
