Legal Implications of Independent Contractor Status

Description

Independent-contractor status has become highly politicized due in part to the rapid growth of the gig economy. This politicization has resulted in aggressive government enforcement actions targeting companies that do business with independent contractors and a growing cottage industry of plaintiff attorneys bringing lawsuits alleging worker misclassification. The program will provide an overview of the different types of legal risks associated with independent-contractor status, the different tests courts apply to determine an individual’s status, and a heuristic method for quickly evaluating the defensibility or vulnerability of an independent-contractor relationship.
