The program topic:

“Practical Approaches to Police Liability”

  1. Case law updates.Section 1983 lawsuits remain prevalent and high-risk, but the state of qualified immunity is strong (for now . . . .). The panel will survey recent jurisprudence from the United States Supreme Court and from this Circuit, and will address recent proposals in academia to eliminate the defense of qualified immunity in federal civil rights cases.
  1. Practical approaches to higher-risk cases.The biggest risk by dollar value remains the exoneration case, and today’s (or yesterday’s) mistakes could cost your municipality millions in damages and fees. The panel will discuss practical steps that each Attorney’s office should be taking to minimize its exposure in such cases that may be on the immediate horizon, or that may be decades away. The discussion will focus on internal training and auditing, procedures and record-keeping, effective coordination and communication with prosecutors, and early identification of tomorrow’s big plaintiffs.
