This ethics CLE is an overview of the disciplinary procedures–from complaint to charging to sanction–in both Maryland and the District of Maryland. The program will cover the key Rules of Professional Conduct, Model Rules of Professional Conduct 8.1 and 8.4, that are implicated by attorney disciplinary proceedings, the Maryland Court Rules that govern state disciplinary proceedings, and the extensive procedures for investigating and prosecuting ethical complaints embodied in the District of Maryland’s Local Rules. The first portion of the program will outline the processes for Maryland and federal disciplinary cases, including key areas where they differ and recent trends. The second portion of the program will provide practical advice on advocacy and potential pitfalls in the disciplinary process.
