Online mediation became the safer alternative for dispute resolution during COVID-19 social distancing times, and the convenience for both mediators and their clients has made it a continuing and popular practice still. But mediating online can lead to issues of privacy and confidentiality when the clients’ environment is out of the mediator’s control. This program will address the practical and ethical considerations for mediators and attorney participants when conducting online mediations. Our expert panelist will address: 

  • Online mediation in the time of Coronavirus 
  • Understanding the tools, platforms and key features for mediating safely 
  • Developing mediation rapport through technology
  • Maintaining confidentiality with technology
  • Recording tools, smartphones, and other off-screen distractions
  • Exploring creative outcomes and solutions remotely

 This program will examine the following ethics rules:

  • ABA Model Rule 1.4 Communications
  • ABA Model Rule 1.6 Confidentiality of Information

Presented by Todd C. Scott, VP Risk Management of Risk Management for Minnesota Lawyers Mutual Insurance Company and Kristi Paulson, Esq. of Kristi Paulson Law. This course satisfies continuing education requirements for Maryland circuit court mediators.

One hour CLE credit (with 1.0 ethics hour offered to Pennsylvania ONLY) will be offered for the surrounding MCLE states.
