Employment of attorneys: Successive Government and Private Practice

Based upon the circumstances surrounding the representation of the wife and the prior (and somewhat ongoing) prosecution of the husband for criminal offenses, you have asked for an ethics opinion. You have also enclosed, as attachments to your inquiry, copies of pleadings filed in the action which seek to have the State's Attorney disqualified from this action.

  This Committee does not issue opinions on matters that are currently in litigation. See Ethics Opinion 88-43. For your reference, Ethics Opinion 88-8 discusses a situation similar to the one presented in your inquiry.
