The Maryland State Bar Association (MSBA) remains steadfast in its role as a nonpartisan guardian of the legal framework that defines our democracy. Indeed, supporting the Constitution is part of the very oath taken by all new Maryland lawyers.
MSBA recognizes the federal government’s established authority to enforce federal statutes, including those governing immigration. Federalism, the Supremacy Clause, and individual rights conveyed under the Fourth and Fifth Amendments, among others, are all rubrics of a civilized society that underscore the rule of law. All enforcement actions must be executed in a manner consistent with the protections of the U.S. Constitution and the rule of law.
The integrity of our legal system relies on the delicate balance between federal government authority, state government authority, and individual rights. Central to this balance is the independence of the judiciary and a commitment to due process. Respect for due process protections, judicial oversight, and the separation of powers is not optional; it is the cornerstone of a predictable and fair society. Following these foundational principles assures the public’s trust in the legal system.
As an organization representing officers of the court, MSBA believes that the strength of our nation lies in its adherence to the U.S. Constitution and the rule of law.
