This session provides a comprehensive exploration of the stages of negotiations, common settlement dynamics, and maximizing the benefits of the mediation process. The course breaks down the stages of negotiation, from initial discussions to final closure, while addressing the unstated realities that often drive parties’ actions and impede progress in mediation. Participants will also learn to distinguish and recognize the difference between the substantive merits of a case and the settlement dynamics of the dispute, including the impact of pacing, making and responding to unrealistic offers, positional bargaining, creating leverage, changing up the dynamics, and getting to final closure.

One hour credit will be offered for the surrounding MCLE states.
