Each year, hundreds of thousands of Veterans and their beneficiaries apply for VA disability compensation and pension benefits. Most applicants are denied the complete benefits they are seeking and, therefore, are in need of legal professionals who will zealously represent them in appellate proceedings before the VA Regional Offices, the Board of Veterans’ Appeals (“Board”), the U.S. Court of Appeals for Veterans Claims (“CAVC”), and the U.S. Court of Appeals for the Federal Circuit (“Federal Circuit”). Most advocacy before these diverse tribunals is written. However, the requirements for effective representation vary widely depending on the specific agency or federal court in which an appeal is pending. During this presentation—which is intended both for practitioners who currently represent disabled Veterans and their families and for aspiring advocates of these underserved heroes—we will explore techniques for composing legal work products that are persuasive—and prevailing—before the vast array of officials who adjudicate Veterans’ claims and appeals, ranging from Decision Review Officers at the VA Regional Offices to Veterans Law Judges at the Board of Veterans’ Appeals to Article I and II Judges at the CAVC and Federal Circuit.
